Hi there,
We have received some questions from drivers regarding the recent BULit21 legal claim and are writing to share some additional information we hope is helpful.
What is BULit21?
BULit21 is a claim by a group of London black cab drivers, managed by RGL Management. RGL Management explains on their website that: “The BULit21 drivers’ claims will be legal claims for drivers’ losses incurred between June 2012 and March 2018.” It does not therefore relate to Uber’s current operations. Registration has now closed, and a Claim Form was filed in the High Court in 2024 on behalf of over 13,000 drivers. Uber denies the claim and is defending it.
What is Curb Flow?
Curb Flow was launched in 2023. As a black cab driver, Curb Flow is a technology platform connecting you to passengers, including those referred through the Uber network. You remain a licensed hackney carriage driver at all times, operating your own meter. All Curb Flow trips are trips dispatched by Curb to you as a hackney carriage driver, and are not private vehicle trips. Drivers accepting trip requests through the Curb Flow network are contracted with Curb. Therefore, all communications and interactions are only between participating drivers and Curb. There are no exclusivity requirements and no obligation to accept any trip.
How does BULit21 impact Curb Flow?
It does not. BULit21 is a historical claim and it has no bearing on Curb Flow or your ability to use it today.
- There is nothing in Curb Flow’s or Uber's terms and conditions that would prevent drivers from receiving a payout from the claim if they have chosen to participate in the BULit21 claim and take Uber referred trips.
-
In addition, drivers' participation in the BULit21 claim will have no bearing on their ability to take Uber referred trips.
- The Curb Flow terms and conditions do not contain any waiver or signing away of rights for the BULit21 claim.
In short: accepting Uber referred trips through Curb Flow does not constitute a waiver of any legal rights you may have in the BULit21 claim.
From the BULit21 Legal Team's Published FAQs:
- "Working for Uber now does not impact this legal claim (unless Uber does insist drivers sign away/give up their right to claim".
-
"As long as by signing up with Uber, you do not sign away your right to take legal action against them, then working for Uber now in 2024 would not jeopardize your BULit21 legal claim".
We encourage you to read the BULit21 FAQs directly, and to seek independent legal advice if you have any questions about your specific situation.
